Open Question to the group – If Congress passes a law (health care for example) by what authority does the executive branch have the power to say that some entities do not have to follow the law?
It seems hard to argue with Wayne's answer. And it seems like a no-brainer that this kind of exception-making should be kept to an absolute minimum, if it's done at all.
(I suppose the idea of the Presidential pardon does sort of accomplish this, but that's a narrower circumstance than Tom is asking about I think.)
I would think that the authority would have to be included in the law or some other act of Congress.

My gut feel, and hope, is that Wayne is correct.
